Growth Terms & Conditions

These Terms & Conditions apply for all Growth Services

Effective Date: December 17, 2024

This document (the "Growth Terms") is an extension of the Service Terms and Conditions (the "Service Terms") and incorporates their provisions. The following terms specifically govern growth services:

Principles

  1. These Growth Terms operate under the Service Terms, which remain fully applicable.
  2. All growth-related services are governed by a duty of care obligation. I commit to applying my best professional skills and diligence without guaranteeing specific results.

Service Provision and Fees

  1. Every service categorized under 'Growth' is dedicated to the exclusive sharing of "Intellectual Capital" (also maybe abbreviated as "IC") belonging to myself and my colleagues, encompassing:
    • know-how: Practical knowledge, ability, and expertise required to accomplish tasks, create products, or offer services efficiently and effectively. It encompasses a wide range of tacit and often proprietary knowledge crucial for operational success.
    • best-practices: Sets of methods and techniques that produce optimal results, increase efficiency, and develop structured processes. These are often established by authorities or highly successful organizations and are considered the most effective course of action in specific situations.
    • business practices: The strategies, processes, and principles adopted by companies to operate effectively in their respective industries. These practices guide decision-making and are essential for achieving organizational goals.
    • technical skills: Abilities required to perform specific tasks using physical or digital tools. These skills are often industry-specific and include expertise in areas such as programming, data analysis, and technical writing.
    • non-technical skills: Also known as soft skills, these are personal attributes and interpersonal abilities that enable professionals to work effectively with others and adapt to changing circumstances. Examples include communication, teamwork, and problem-solving.
    • soft-skills: Personal attributes that enhance an individual's interactions, job performance, and career prospects. These include communication, teamwork, adaptability, and emotional intelligence.
    • hard-skills: Specific, teachable abilities or knowledge sets that are required to perform particular tasks. These skills are often quantifiable and include technical proficiencies such as coding, machine operation, and data analysis.
    • life-experience: The accumulation of knowledge or skills gained through personal life events and activities. This includes experiences that shape an individual's worldview and personal development.
    • professional-experience: The knowledge and skills acquired through work in a specific field or occupation. This includes practical experience gained through employment, internships, or professional training.
    • societal-experience: The understanding and insights gained from interacting with and participating in society. This includes experiences related to cultural, social, and community activities.
    • psychological-experience: The insights and understanding gained from personal mental and emotional experiences. This includes knowledge of one's own psychological processes and those of others.
    • professional- or non-professional-philosophy: A set of beliefs or principles that guide an individual's professional or personal conduct. This philosophy can influence decision-making, ethical considerations, and overall approach to life and work.
  2. By engaging with Growth services, you acknowledge that any knowledge or skills acquired are solely for your personal intellectual enrichment. You do not gain ownership of the intellectual property; rather, you receive an intellectual copy for your own use. You are strictly prohibited from redistributing this knowledge or any related materials for financial, societal, individual, or any other type of gain.
  3. All materials provided during a Growth engagement remain my exclusive property. No individual or entity has the right to record, retain, preserve, distribute, or utilize these materials in any form without my prior written consent. Written consent must be provided through a formal, signed document, either physically or digitally.

  4. All shared information between you, your peers, me, and my peers is confidential. Any breach of this confidentiality will result in a fine of $1000 for each instance of non-compliance.

Liability and Disputes

  1. My liability is limited, as described in of the Service Terms.
  2. You are solely responsible for any decisions based on my growth services.
  3. Disputes arising from these Growth Terms are subject to the Service Terms.
  4. My liability is strictly limited to the scope of services provided, and I do not warrant the effectiveness or outcomes of the services. You acknowledge and accept that any decisions made based on my advice are solely your responsibility.
